4. On-premise signs, displays or other advertising devices will not be permitted. The LESSEE
<br />is permitted to erect such directional or operational signs as may be required. All signs shall
<br />be subject to the prior approval of the STATE.
<br />5. No vending of any kind or character shall be conducted, permitted or allowed upon the
<br />premises.
<br />6. The LESSEE shall, at its sole expense, keep and maintain the premises free of all tall grass,
<br />weeds, debris, and inflammable and hazardous materials of every description and at all times
<br />in an orderly, clean, safe and sanitary condition. A high standard of cleanliness, consistent
<br />with the location of the area as an adjunct of the State of Ohio Highway System, will be
<br />required.
<br />7. The LESS]EE hereby agrees to indemnify and hold harmless the STATE (Ohio Department
<br />of Transportation ) its employees, agents, coniraciors and ofiicials oi tne Deparimeni againsf
<br />any and all damages, claims, liability, loss, fines or expenses, including, but not limited to,
<br />attorneys fees and litigation costs related to the discovery, presence, disposal, release or
<br />clean-up of any contaminants, hazardous substances, or pollutants, or environmental
<br />conditions located in, on, over, under, from or affecting the property subject to this contract,
<br />or the soil, water, vegetation, buildings or personal property located thereon, whether known
<br />or unknown, as well as any personal injury or property damage related to or cause such
<br />contaminants, hazardous substances, pollutants or environmental conditions. The STATE
<br />reserves the right to require that the LESSEE perform, within a reasonable period of time,
<br />an environmental survey/audit certifying that the property subj ect to this Agreement is
<br />environmentally acceptable, and to furnish a report containing the survey/audit findings to the
<br />STATE. The indemnity set forth herein shall apply to all conditions existing after the date
<br />this Agreement was executed by the LESSEE and the STATE.
<br />The LESSEE shall secure all necessary permits required in connection with operations on the
<br />premises and shall comply with all Federal, State and Local statutes, ordinances, or
<br />regulations which may affect, in any respect, LESSEE'S use of the premises.
<br />9. No bulk storage or stock piling of debris or other materials will be allowed. The LESSEE
<br />shall be liable to and shall reimburse the STATE for any damage to STATE owned fences or
<br />guardrails in any way resulting from or attributable to the use and occupancy of said premises
<br />by the LESSEE or any person entering upon the same with the consent of the LESSEE,
<br />expressed or implied.
<br />10. The LESSEE shall occupy and use said premises at its own risk and expense and shall save
<br />the STATE, the officers, agents and employees, harmless from any and all claims for damage
<br />to property, or injury to, or death of, any person, entering upon same with consent of the
<br />LESSEE, expressed or implied.
