- ORDINANCE NO. 2005-19 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />. TO APPROPRIATE A FEE SIMPLE INTEREST IN AND TO THE <br />PREMISES LOCATED AT 500 S.O.M. CENTER ROAD AND KNOWN AS <br />PERMANENT PARCEL NO. 831-09-005 TO FURTHER <br />THE PUBLIC PURPOSES OF ECONOMIC DEVELOPMENT AND THE <br />CONSERVATION OF NATURAL RESOURCES IN THE VILLAGE <br />WHEREAS, this Council has determined that in the promotion of the health, <br />safety and welfare of the residents of the Village, it is necessary to appropriate for <br />economic development and the conservation of natural resources in the Village a <br />fee simple interest in and to the premises located at 500 S.O.M. Center Road and <br />known as Permanent Parcel No. 831-09-005; and <br />WHEREAS, on May 9, 2005, this Council passed Emergency Resolution <br />No. 2005-10 which was personally delivered to the owner of record of the subject <br />property; and <br />WHEREAS, negotiations to purchase a fee simple interest in the property <br />have been had and the Village and the owner are unable to agree; and <br />WHEREAS, the Village desires to take the above-referenced property by <br />instituting an eminent domain proceeding under Ohio Revised Code Chapter 163 <br />for the reason that such land is needed for purposes of economic development <br />and the conservation of natural resources in the Village, the Petition filed with the <br />Probate Court will indicate and include a statement of value of the property being <br />appropriated. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO THAT: <br />SECTION 1. A fee simple interest in the premises located at 500 S.O.M. <br />Center Road and known as Permanent Parcel No. 831-09-005 as further <br />described in Exhibit "A" attached hereto and which are incorporated herein by <br />reference as if fully rewritten, is appropriated for the purposes of economic <br />development and the conservation of natural resources in the Village pursuant to <br />the Constitution and the laws of the State of Ohio. <br />SECTION 2. Council finds #hat the appropriation is necessary for public <br />purposes and that the Village has been unable to agree on a fair market value with <br />the owner of the property.
