ORDINANCE NO. 2005-38 <br />19VTRODUCED BY: Mayor Rinker and Council as a Whole <br />AIV EMERGENCV ORDINANCE <br />AUTHORIZING,4ND DIRECTING THE MAYOR TO ENTER <br />INTO ABIKE PATH EASEMENT AGREENiENT WITH AIK IUdAYFIELD VILLAGE <br />LLC AND SOM COURI" DEVELOPMENT CORPORATION <br />AS AND FOR TNE RIGFiT TO CONSTRUCT AND MAINTP,IN, PATROL AND <br />USE CERTAIN PROPERTY FOR AfV ALL PURPOSE fVON-VEFIICULAR PUBLIC <br />HIKIIVG AND BIKING TRAIL AND RELATED PURPOSES <br />WHEREAS, the Village of Mayfield desires to construct an all purpose Hike <br />and Qike Trail throughout the Village in the interest of promoting pedestrian travel <br />and for recreational purposes; and <br />WHEREAS, certain property owned by AIK iV6ayfield Village LLC and SOIVI <br />Court Development Corporation is required to fiacilitate such purposes; and <br />WHEREAS, AIK iViayfield Village LLC and SOM Court Development <br />Corporation have agreed to enter into a Bike Path Easement Agreement with the <br />Village of Mayfield allowing the use of such certain property for such purposes. <br />NOW, THEREFORE, BE IT ORDA9IVED BY THE COUfVCIL OF MP?YFIELD <br />VILLAGE, OHIO THAT: <br />SECT90N 1. The Village of Mayfield hereby authorizes and directs the <br />Mayor to enter into a Bike Path Easement Agreement with AIK Mayfield Village <br />LLC and SOM Court Development Corporation whereby AIK Mayfield Village LLC <br />and SOM Court Development Corporation have agreed to grant the Village the <br />right to construct, maintain, patrol and use a certain part of their premises for an <br />all-purpose reon-vehicular public Hiking and Biking Trail and related purposes as <br />more fully set forth in the Bike Path Easement Agreement attached hereto and <br />incorporated herein by reference as Exhibit "A". <br />SECTIDN 2. The Council finds and determines that all formal actions of <br />this Council relating to the adoption of this Ordinance have been taken at open <br />meetings of this Council; and that deliberations of this Council and of its <br />committees, resulfing in such formal action, took place in meetings open to the <br />public, in compliance with all statutory requiremenfs including the requirements of <br />Section 121.22 of the Ohio F2evised Code.
