landscaping, directional or informational signage, or .otli.er appurtenances as the Village may <br />reasonably deem necessary or as may reasonably become necessary for, or in connection with, <br />the Bike Path Easement. Except as specified above, no right is granted to the Village to cause <br />the Bike Path Facilities to be relocated beneath or above the surface of the AIK-SOM Property; <br />(b) enter and pass on, over and across any part of said Bike Path Area when <br />reasonably necessary to access the Bike Path Facilities; <br />(c) trim, cut and remove at any and all times any trees, limbs, roots, underbrush or <br />other obstructions within said Bike Path Area which may, in the reasonable judgrnent of the <br />Viilage, interfere with or endanger users of the Bike Path Facilities; and <br />(d) construct and/or install fiber optic cables in the event the Village determines that <br />it is able to wire the Village. . <br />3. Reversion, Termination of Easement. At such time as the Village determines, whether by <br />legislation, resolution, ordinance, or other official act, that the Bike Path Facilities, Bike Path <br />Easement, or Bike Path Area shall be abandoned, or that the use thereof sha11 be discontinued for <br />recreational purposes or for the use of and by the general public, the Bike Path Easement shall <br />cease to exist, and the rights granted to the Village hereunder shall immediately become null and <br />void, and the Bike Path Facilities, Bike Path Easemerit or Bike Path Area sha11 become and be <br />treated for all purposes as part of the Conservation Area, subject to all of the terms, conditions, <br />limitations and requirements applicable to the Conservation Easement as described in Section I <br />above. <br />IV. GENERAL PItOVISIONS <br />1. Easements Appurtenant and Run With Propertv. This Agreement and all easements <br />created or described herein are intended to be appurtenant to the parcel which they benefit. The <br />easements and covenants herein shall run with the AIK-SOM Property and the Village Property <br />and shall inure to the benefit of and bind the respective parties hereto, their 1ega1 representatives, <br />transferees; grantees and assigns. The Conservation Area, the Bio-Detention Area, and the Bike <br />Path Area may hereinafter be referred to together as, the "Easement Areas," the Conservation <br />Easement, the Bio-Detention Easement, and the Bike Path Easement may hereinafter be referred <br />to together as, the "Basements," and the Conservation Purpose, the Bio-Detention Purpose, and <br />the Bike Path Purpose may hereinafter be referred to together as, the "Purposes." <br />2. I'ermitted Uses. AIK-SOM and the Village retain all ownership rights to their respective <br />portions of the Easement Areas that are not expressly restricted by the herein grants of easement. <br />Without limiting the generality of the foregoing, the following rights are reserved to the Village <br />and to AIK-SOM and their respective heirs, personal representatives, successors and assigns, <br />each with respect to their owned portions of the Easement Areas: <br />(a) The Village and AIK-SOM retain the right to sell, mortgage, bequeath, donate <br />or otherwise dispose of their respective portions of the Easement Areas; <br />. (b) Except as set forth herein, the Village and AIK-SOM retain the right to limit <br />public access to the Conservation Area, Bio-Detention .Area, and Bike Path Area; <br />CLEV 1997_1472356_S.DOC 6
