ORDINANCE NO. 2005-48 <br />INTRODUCED BY: Mayor F2inker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING AND DIRECTIIVG THE fiIIAYOR TO <br />ENTER INTO A DEVELOPNIENT AGREEMENT WITH <br />MF REAL ESTATE PARTNERS, LLC AKA MAYFRAN <br />RELATIVE TO 6650 BETA DRIVE <br />WHEREAS, MF REAL ESTATE PARTIVERS, LLC AKA MAYFRAN and the <br />Village desire to enter into a Development Agreement for the purpose of facilitating <br />the expansion of their facilities at 6650 Beta Drive, Permanent Parcel Number <br />831-12-004; and <br />WHEREAS, the Village will agree to a Tax Incremental Financing <br />Agreement and reciprocal arrangements between the Village and MF REAL <br />ESTATE PARTNERES, LLC AKA MAYFRAN with regard to the construction and <br />installation of conduit and fiber optics in and around 6650 Beta Drive and <br />landscaping and improvements on and about the property. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO THAT: <br />SECTION 1. The Mayor and Director of Finance are authorized and <br />directed to enter into the Development Agreement with MF REAL ESTATE <br />PARTNERS, LLC AKA MAYFRAN, in a form substantially similar to that set forth <br />in Exhibit "A," attached hereto and incorporated herein by reference. <br />SECTION 2. The Council finds and determines that all formal actions of this <br />Council relating to the adoption of this Ordinance have been taken at open <br />meetings of this Council; and that deliberations of this Council and of its <br />committees, resulting in such formal action, took place in meetings open to the <br />public, in compliance with all statutory requirements including the requirements of <br />Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency <br />measure immediately necessary for the health, safety and welfare of the residents <br />of Mayfield Village, Ohio. It shall, therefore, take effect immediately upon the <br />passage by the affirmative vote of not less than five (5) members elected to <br />Council and approval by the Mayor or otherwise at the earliest time allowed by <br />law.
