EMERGENCY ORDINpeNCE NO. 2005-50 <br />INTRODUCED BV: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING THE MAYOR AIVD PRESIDENT OF COUNCIL TO <br />ENTER INTO AN EASEMENT TERMINATION AGREEMENT <br />TERNiINATING AN EASE?V1iENT EiVTERED INTO ON APRIL 28, 1980 <br />BETWEEN THE VILL.AGE AND PETER GALIER AND ELIO C. CARLINI <br />FOR THE INSTALLATION AND NIAINTENANCE OF <br />A WATER MAIN AT 651 BETA DRIVE <br />WFiEREAS, on or about April 28, 1980 Peter Galier and Elio C. Carlini, <br />previous owners of the real estate located at 651 Beta Drive executed a standard <br />easement for the installatian and maintenance of vyater main; and <br />WHERENS, after consultation with the Village's Engineer, it has been <br />.detercnined that there is no need for such easement and #hat the same may now <br />be terminated. <br />NOW, TFiEREFORE, BE IT ORDAINED BY THE COUNCIL OF <br />iVIAYFIELD VILLAGE, OHiO, THAT: <br />SECTION 1. The Mayor and President of Council are herein and hereby <br />authorized to enter into the Easement Termination Agreement and/or in a form . <br />substantially similar thereto as set forth in Exhibit "A" attached hereto and <br />incorporated herein by reference. <br />SECTION 2. The Council finds and determines that all formal actions of <br />this Council relating to the adoption of this Ordinance have been taken at open <br />meetings of this Council; and that deliberations of this Council and of its <br />committees, resulting in such formal action, took place in meetings open to the <br />public, in compliance with all sta#utory requirements including the requirements of <br />Section 121.22 of the Ohio Revised Code.
