Pi <br />'~~''-- RESOLUTION NO. 96-06 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY RESOLUTION <br />APPROVING THE WILSON MILLS ROAD WATER MAIN <br />EXTENSION TO THE GATES MILLS CORPORATION LINE <br />WHEREAS, the Village of Gates Mills has proposed the extension <br />of a twelve inch water main through the Village of Mayfield east of <br />Echo Drive to the Gates Mills Corporation line; and <br />WHEREAS, the Village Engineer has reviewed the plans for same <br />and has approved them with contingencies. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Village of Gates Mills is hereby and <br />herein authorized to enter upon the right of way of the Village of <br />Mayfield as and for the purpose of installing a twelve inch water <br />main extension east of Echo Drive to the Gates Mills Corporation <br />line, pursuant to the plans approved by the Village Engineer and <br />providing the contingencies of the Engineer's approval are complied <br />with. Further, such approval is contingent upon the Village of <br />Gates Mills causing the restoration of any disturbed property to be <br />~ made completely in conformance with the existing status of the <br />property prior to its being disturbed for this project. <br />SECTION 2. The Clerk is directed to certify a copy of this <br />Resolution to the Village of Gates Mills. <br />SECTION 3. The Council finds and determines that all formal <br />actions of the Council relating to the adoption of this Resolution <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Resolution is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the <br />health, safety and welfare of the residents of Mayfield Village. <br />It shall, therefore, take effect immediately upon passage by the <br />affirmative vote of not less than five (5) members elected to <br />Council and approval by the Mayor or otherwise at the earliest time <br />allowed by law. <br />K FIXI~ R, <br />Council President <br />.r <br />F <br />
