i <br />I <br />I <br />RESOLUTION NO. 96-11 ~ <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />i <br />AN EMERGENCY RESOLUTION <br />AUTHORIZING A SUPPLEMENTAL AGREEMENT WITH THE DIRECTOR <br />OF ENVIRONMENTAL PROTECTION AND THE OHIO WATER <br />DEVELOPMENT AUTHORITY FOR AN ADDITIONAL LOW INTEREST <br />LOAN FOR THE WORTON PARK SANITARY SEWER PROJECT <br />WHEREAS, the Village and the EPA, and Ohio Water Development <br />Authority (OWDA), have heretofore entered into a Water Pollution <br />Control Loan Fund Agreement on or about October 26, 1995; and <br />i <br />WHEREAS, it has been determined that the eligible project <br />costs will exceed the original loan, .and the State and OWDA have <br />agreed to make additional funds available for the construction of <br />the Worton Park Sanitary~Sewer project. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the~Mayor is hereby and herein authorized and <br />directed to enter into a~ supplemental agreement with the EPA and <br />OWDA as and for an additional $150,800.00 in low interest loans, <br />4.04%, for the Worton Park Sanitary Sewer project, upon the same <br />terms and conditions as the original agreement in October of 1995, <br />such supplemental agreement being attached hereto and incorporated <br />herein as Exhibit "A". <br />SECTION 2. The Council finds and determines that all formal <br />actions of the Council relating to the adoption of this Resolution <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Resolution is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the <br />health, safety and welfare of the residents of Mayfield Village. <br />It shall, therefore, take effect immediately upon passage by the <br />affirmative vote of not less than five (5) members elected to <br />Council and approval by the Mayor or otherwise at the earliest time <br />allowed by law. <br />MARK FIXL , <br />Council President <br />First Reading: April 1~5 , 1996 <br />Second Reading: n/a~~ ~'<~.. , 1996 <br />Third Reading: ":n/a , 1996 <br />
