RESOLUTION NO. 96-24 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY RESOLUTION EXTENDING THE CURRENT FRANCHISE AGREEMENT WITH CABLEVISION, INC., TO OCTOBER 31, 1997 WHEREAS, the Village of Mayfield and Telerama, Inc. (d.b.a. Cablevision) parties to a non-exclusive franchise for the use of public rights-of-way for purposes of providing cable television; and WHEREAS, the Village of Mayfield will begin negotiating the terms of the renewal of that franchise; and NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That Council does hereby agree to extend the existing franchise agreement until October 31, 1997. This extension shall be subject to the same terms and conditions as set forth in the current franchise agreement and shall impose upon Cablevision and/or the franchising authority no additional rights or responsibilities than what are currently imposed upon it. SECTION 2. The Council finds and determines that all formal actions of the Council relating to the adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 3. This Resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the health, safety and welfare of the residents of Mayfield Village. It shall, therefore, take effect immediately upon passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law.
