? ORDINANCE NO. 96-07 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />CREATING CHAPTER 973 OF THE CODIFIED ORDINANCES <br />RELEVANT TO ANIMAL CONTROL <br />WHEREAS, the Village pays Animal Warden expenses for the <br />maintenance and control of wild animals throughout the Village, as <br />a service to all residents; and <br />WHEREAS, it has come to the attention of Council that on <br />occasion, residents are advised by the Animal Warden how to prevent <br />the attraction of wild animals, and to avoid such animals causing <br />a nuisance to the residents; and <br />WHEREAS, the Village pays for such services and the repeated <br />calling of the Animal Warden after due notice on preventative <br />measures have been ignored, is an unfair burden to the balance of <br />the taxpayers in this Village. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That Chapter 973 of the Codified Ordinances is <br />hereby and herein created to read as follows: <br />0 CHAPTER 973 <br />Animal Warden Expenses <br />973.01 ANIMAL WARDEN EXPENSE5. <br />Any resident property owner or tenant who requires <br />the services of the Animal Warden, or the Service <br />Department because of the existence of wild animals, <br />fowl, or rodents, and has failed to follow the <br />recommendations of the Animal Warden after the providing <br />of such service on any prior occasion, shall be liable <br />for the reimbursement to the Village of all costs <br />incurred by such service being provided. The Animal <br />Warden shall advise the Service Department of all <br />situations where property owners have been given <br />recommendations or advice on how to protect or prevent <br />nuisance animals, fowl or rodents. The Service <br />Department will monitor such programs, and cause the <br />billing to the property owners once repeated service is <br />required and failure to follow recommendations has been <br />determined. <br />SECTION 2. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />? sucli formal action, took place in meetings open to the public, in <br />,
