ORDINANCE NO. 96- 10 <br />PAGE TWO <br />Council may review the transcript and minutes of the Board <br />hearing, or have a rehearing in front of Council, and mav <br />affirm the decision of the Board of Zoning Appeals, or, with <br />a 2/3 majority vote, modify or reverse the decision. <br />(e) The Board may not grant a variance or exception to <br />the zoning regulations or building codes, unless the applicant <br />has shown that the literal application of the provisions of <br />SECTION 2. That Section 1113.25 is hereby and herein amended <br />to read as follows: <br />1113.25 VARIANCE. <br />"Variance" means a modification of the zoning or buildina <br />regulations, permitted in instances where a literal <br />application of the provisions of the Zoning or Buildina Code <br />would result in unnecessary hardships or practical <br />difficulties as a result of some peculiar or unique condition <br />or circumstance pertaining only to the zoning lot in question <br />in accordance with procedures and standards set forth in the <br />Zoning Code. <br />SECTION 3. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the health, safety and <br />welfare of the residents of Mayfield Village, Ohio, and for the <br />further reasons set forth in the preamble hereof.
