ORDINANCE NO. 96- 11 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />REPEALING SECTION 1149.08 RELATIVE <br />TO VARIANCES BY COUNCIL <br />WHEREAS, the recent Charter amendments adopted by the voters <br />in November 1995, have eliminated the original authority of Council <br />to grant variances in the nonresidential areas of the Village; and <br />WHEREAS, Section 1149.08 sets forth certain procedures which <br />were required of Council when considering or adopting any variances <br />or exceptions to the Village zoning or building codes; and <br />WHEREAS, the elimination of Council's original authority to <br />grant variances thereby eliminates the necessity for the <br />restrictions and guidelines set forth in Section 1149.08. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That Section 1149.08, in its entirety, is hereby <br />and herein repealed, effective January l, 1996. A copy of Section <br />1149.08, as repealed, is attached hereto and incorporated herein as <br />Exhibit "A". <br />SECTION 2. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the health, safety and <br />welfare of the residents of Mayfield Village, Ohio, and for the <br />further reasons set forth in the preamble hereof.
