ORDINANCE N0.,96-16 <br />INTRODUCED BY: Mayor <br />AN <br />AUTHORIZING THI <br />WITH JACK MAXTOP <br />OF ADVERTISEMENT <br />NOT TO EXCEED THIR7 <br />AS AND FOR THE PLTf <br />and Council as a Whole <br />EMERGENCY ORDINANCE <br />MAYOR TO ENTER INTO A CONTRACT <br />CHEVROLET WITHOUT THE NECESSITY <br />AND FORMAL BIDDING FOR AN AMOUNT <br />Y SIX THOUSAND DOLLARS ($36,000.00) <br />CHASE OF TWO 1996 CHEVY POLICE CARS <br />WHEREAS, the Villagelhas previously entered into a contract with <br />Burton Ford as and for twol(2) 1996 police cars; and <br />WHEREAS, since Noveml3er of 1995 when the legislation authorizing <br />such purchase was enacted, IBurton Ford has gone out of business, and has <br />been taken over by a new entity no longer bound by the contracts of its <br />predecessor; and I <br />WHEREAS, the new entity has taken delivery of the two police cars, <br />but will not honor the contract price with Burton Ford, and has invoked <br />an increase of $2,446.00 aliove the original purchase order, for a total <br />of $39,154.00; and <br />WHEREAS, Jack Maxton Chevrolet, in Columbus, Ohio, has two suitable <br />1996 Chevy police cars immediately available for a purchase price of <br />Thirty Five Thousand Three Hundred Ninety Nine Dollars ($35,399.00), <br />which would be $3,755.00 less than the State authorized dealer's price <br />as it is currently placed, jand $1,309.00 less than the original purchase <br />order amount; and WHEREAS, Section 735.1 051 of the Ohio Revised Code provides that in <br />the case of a real and pres?ent emergency arising in connection with the <br />maintenance and operation of any municipal department, the legislative <br />authority may, by two-thi?rds (2/3) vote of all its members elected <br />thereto, authorize the Mayor to enter into a contract for the immediate <br />improvement of public property without formal bidding and advertising; <br />and <br />WHEREAS, it has been deemed a real and present emergency to <br />purchase these police vehicles for the Village of Nlayfield without the <br />necessity of formal advertlisement and bidding; and <br />WHEREAS, it is the intent of Council to authorize the Mayor of the <br />Village to enter into a !contract for the police cars without the <br />necessity of legal advertisement and formal bidding, in order to <br />immediately protect the Village and to prevent a threat to the health, <br />safety and welfare of the Village residents. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, <br />OHIO, THAT: <br />SECTION 1. That the Mayor is hereby and herein authorized and <br />directed to enter into a contract for the emergency purchase of two 1996 <br />Chevy police cars with Jack Maxton Chevrolet. The Mayor is authorized <br />to enter into such an agreement without advertising and formal bidding <br />and that the same is necessitated by a real and present emergency.
