replacements, if any, are necessary to be made by Tenant and for <br />the further purpose of making said necessary repairs or replace- <br />ments. <br />(e) This Lease and Tenant's obligation hereunder <br />are subject to and contingent upon the following conditions (all <br />of which must be met without cost or expense to the Landlord), <br />which must be satisfied as set forth herein within ninety (90) <br />days from the date of this Lease Agreement: <br />(i) Tenant obtaining all <br />governmental approvals <br />(including, but not <br />limited to, platting, <br />subdivision, zoning, zon- <br />ing variances and/or re- <br />zoning classifications) <br />necessary to allow Tenant <br />to develop the Demised <br />Premises as intended by <br />Tenant. Tenant shall <br />submit applications to <br />commence the appropriate <br />proceedings to obtain <br />such approvals, if neces- <br />sary. <br />(ii) Tenant obtaining all nec- <br />essary Licenses and per- <br />mits enabling Tenant.to <br />construct Tenantfs Facil- <br />ity and operate Tenant's <br />intended business. <br />(iii) Tenant and/or the utility <br />companies receiving from <br />Landlord the easement(s) <br />referred to in Paragraph <br />11 hereinabove, which <br />easement(s) must be ac- <br />ceptable to counsel for <br />Tenant and/or the respec- <br />tive utility companies. <br />16.
