ORDINANCE NO. 97-06 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING AN AGREEMENT WITH AT&T WIRELESS <br />PCS, INC. RELATIVE TO A TOWER LEASE AGREEMENT <br />WHEREAS, AT&T Wireless PCS, Inc. (hereinafter "AT&T"), has proposed an <br />option to obtain a tower lease agreement, and the proposed tower lease agreement, <br />attached hereto and incorporated herein as Exhibit "A"; and <br />WHEREAS, this agreement would be in conjunction with Nextel, who has the lease <br />rights to the existing tower at the new fire station; and <br />WHEREAS, entering into this lease will provide substantial additional revenue to <br />the Village of Mayfield, and help in consolidating the number of towers by requiring more <br />than one company to combine their use of a single tower. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor is hereby and herein authorized and directed to <br />enter into the "Option and Tower Lease Agreement" attached hereto and incorporated <br />herein as Exhibit "A". Minor alterations or changes to this agreement, as recommended <br />by the Law Director, may be approved and permitted without further approval by Council, <br />provided that the location and the amounts of money are not changed or diminished in <br />any way. <br />SECTION 2. The Council finds and determines that all formal actions of this <br />Council relating to the adoption of this Ordinance have been taken at open meetings of <br />this Council; and that deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio, and for the further reasons set forth in the preamble hereof. It shall, <br />therefore, take effect immediately upon the passage by the affirmative vote of not less <br />than five (5) members elected to Council and approval by the Mayor or otherwise at the <br />earliest time allowed by law. <br />
