ORDINANCE NO. 97- 09 ,~ INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE AUTHORIZING THE EXERCISE OF AN OPTION TO PURCHASE THE PARKVIEW GOLF COURSE WHEREAS, the Village entered into a Settlement Agreement concerning litigation between the Village and the LaConte family concerning the real estate located at 320 and 370 S.O.M. Center Road, and commonly known as the "Parkview Golf Course"; and WHEREAS, the terms of the Settlement Agreement included an option in favor of the Village of Mayfield to purchase the golf course prior to July 1, 1997; and WHEREAS, the Village Administration and Council have investigated the ramifications of the purchase, and the financial benefits, as well as planning benefits to the Village of Mayfield and its residents; and WHEREAS, the Administration and Council have concluded that it is in the best interest of the Village to exercise the option and to purchase the Parkview Golf Course upon the terms and conditions set forth in Exhibit"A" attached hereto and incorporated herein by reference. r ~~ ~ NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD ,. VILLAGE, OHIO, THAT: SECTION 1. That the Director of Law is hereby and herein authorized and directed to serve formal notice upon the owners of the Parkview Golf Course evidencing the intent of the Village to exercise the option for the purchase of the Parkview Golf Course pursuant to the Real Estate Option Agreement entered into in 1992, and that such notification shall be served on the owners prior to July 1, 1997. SECTION 2. The Mayor, President of Council, Finance Director, and Director of Law are hereby and herein authorized and directed to enter into the "Agreement of Sale" attached hereto and incorporated herein by reference as Exhibit "A", and to carry out the terms of such agreement to pay all sums required therein. SECTION 3. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 4. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio, and for the further reasons set forth in the preamble hereof. It shall,
