ORDINANCE NO. 97- 09 <br />,~ INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING THE EXERCISE OF AN OPTION TO <br />PURCHASE THE PARKVIEW GOLF COURSE <br />WHEREAS, the Village entered into a Settlement Agreement concerning litigation <br />between the Village and the LaConte family concerning the real estate located at 320 and <br />370 S.O.M. Center Road, and commonly known as the "Parkview Golf Course"; and <br />WHEREAS, the terms of the Settlement Agreement included an option in favor of <br />the Village of Mayfield to purchase the golf course prior to July 1, 1997; and <br />WHEREAS, the Village Administration and Council have investigated the <br />ramifications of the purchase, and the financial benefits, as well as planning benefits to <br />the Village of Mayfield and its residents; and <br />WHEREAS, the Administration and Council have concluded that it is in the best <br />interest of the Village to exercise the option and to purchase the Parkview Golf Course <br />upon the terms and conditions set forth in Exhibit"A" attached hereto and incorporated <br />herein by reference. <br />r ~~ ~ NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />,. VILLAGE, OHIO, THAT: <br />SECTION 1. That the Director of Law is hereby and herein authorized and <br />directed to serve formal notice upon the owners of the Parkview Golf Course evidencing <br />the intent of the Village to exercise the option for the purchase of the Parkview Golf <br />Course pursuant to the Real Estate Option Agreement entered into in 1992, and that such <br />notification shall be served on the owners prior to July 1, 1997. <br />SECTION 2. The Mayor, President of Council, Finance Director, and Director of <br />Law are hereby and herein authorized and directed to enter into the "Agreement of Sale" <br />attached hereto and incorporated herein by reference as Exhibit "A", and to carry out the <br />terms of such agreement to pay all sums required therein. <br />SECTION 3. The Council finds and determines that all formal actions of this <br />Council relating to the adoption of this Ordinance have been taken at open meetings of <br />this Council; and that deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio, and for the further reasons set forth in the preamble hereof.
