f <br />ORDINANCE NO. 97- i3 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />CREATING SECTION 351.13 PROHIBITING <br />CERTAIN PARKING ON FRONT YARDS AND TREE LAWNS <br />WHEREAS, it is the desire of Council, based upon the recommendations of the <br />Ordinance Review Committee and the Planning Commission, to prohibit certain parking <br />of motor vehicles, for the purpose of offering same for sale; in the front yard and tree <br />lawn areas of residential property. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That Section 351.13 of the Codified Ordinances is hereby and <br />herein created to read as follows: <br />351.13 PARKING ON FRONT YARDS OR TREE LAWNS <br />(a) No person or property owner shall, at any time, park or store, or <br />permit to be parked or stored, on residential property, any motor vehicles, truck, <br />tractor-trailer, motorcycle, trailer, bus, boat or other vehicle for the purpose of <br />selling same, between the residential set back line and the public right-of-way, <br />except on the driveway and/or lawful turn-around area. <br />(b) Vehicles parked in such areas for the purpose of selling must be <br />owned by a resident of the premises upon which such vehicle is parked. <br />(c) No vehicle shall be parked, for the purpose of selling, for more than <br />14 days. No person shall display more than two (2) vehicles on any premise <br />during any twelve (12) month period. <br />(d) Signs shall be limited to no more than a total of six (6) square feet <br />in area and must be placed inside the windows of the vehicle. Vehicles without <br />windows may place a single sign no larger than six (6) square feet in area. <br />SECTION 2. The Council finds and determines that all formal actions of thjs <br />Council relating to the adoption of this Ordinance have been taken at open meetings of <br />this Council; and that deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />,~ (2) <br />~~. <br />
