ORDINANCE NO. 97- 26 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING THE MAYOR AND COUNCIL PRESIDENT TO <br />ENTER INTO A CONTRACT WITH CONCORD ROAD EQUIPMENT CO. <br />IN AN AMOUNT NOT TO EXCEED $9,910.00 FOR THE PURCHASE <br />OF A FOUR TON ASPHALT HOT BOX <br />WHEREAS, the Village has advertised pursuant to law for bids to purchase a four <br />ton asphalt hot box, the terms of which are on file; and <br />WHEREAS, the lowest and best bid was that of Concord Road Equipment Co., and <br />the Village Service Director recommends that the award of this contract be granted to <br />such bidder. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: _.- <br />SECTION 1. That the Mayor and Council President are authorized and directed <br />to enter into an agreement with Concord Road Equipment Co. for an amount not to <br />exceed $9,910.00 as and for the purchase of a four ton asphalt hot box, said. bid being <br />attached hereto and incorporated herein as Exhibit "A". <br />SECTION 2. The Council finds and determines that all formal actions of this <br />Council relating to the adoption of this Ordinance have been taken at open meetings of <br />this Council; and that deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio, and for the further reasons set forth in the preamble hereof. It shall, <br />therefore, take effect immediately upon the passage by the affirmative vote of not less <br />than five (5) members elected to Council and approval by the Mayor or otherwise at the <br />earliest time allowed by law. <br />MARK FIXCER <br />Council President <br />First Reading: July ~ , 1997 <br />Second Reading: Suspended , 1997 <br />Third Reading: uspen e , 1997 <br />
