~ ` ~,: EASEMENT FOR DETEI~ITION BASIN PURPOSES FROM THE HAYFIELD CITY SCHOOL DISTRICT TO THE VILLAGE OF HAYFIELD KNOW ALL MEN BY THESE PRESENTS, that the HAYFIELD CITY SCHOOL DISTRICT, hereinafter called Grantor, for the consideration of One Dollar ($1.00) and other valuable consideration, received to its full satisfaction of the VILLAGE OF HAYFIELD, OHIO, hereinafter called Grantee, does hereby give, grant, bargain and convey to said Grantee, its successors and assigns, the easement and perpetual right to enter upon and to construct, maintain and use a detention basin, retaining wall and appurtenances in, across and under the premises set forth and described in Exhibit "A", which is attached hereto and incorporated herein by reference. This easement grants to Grantee the right and easement to enter onto the premises and to install, repair and maintain therein a detention basin and retaining wall, together with appurtenances, and the making of all repairs to the detention basin, retaining wall, associated services and al( appurtenances connected therewith that in the opinion of the proper local authorities of the Village of Mayfield and their successors or assigns may be necessary at any time, acrd to do anything that may be necessary or advisable in the judgment of the authorities of the Village of Mayfield and their successors or assigns in order to maintain or operate the detention basin and appurtenances in accordance with the Ordinances, Laws, or Rules and Regulations for the management and protection of said Village of Mayfield. Grantor hereby restricts said premises within the limit of the easement against the construction thereon of any buildings of a temporary or permanent type. Grantor also restricts the destroying or placing of any materials, equipment or any other obstructions, or otherwise interfering with access to the maintenance of the detention basin and appurtenances. Grantor reserves the right to use the premises within the limits ofi the easement for the passage or transportation of personnel, materials or equipment and to make such other use of the premises within the limits of the easement as are not expressly prohibited or inconsistent with the rights and the easement hereby granted. Grantor, for itself and its successors and assigns, covenants with Grantee, and its successors and assigns, that it is well seized of the described premises, has a good and indefeasible estate in fee simple, has a right to grant the same and ~nrill warrant and defend the premises with the appurtenances thereunto belonging to the Grantee, and its successors and assigns, against all lawful claims and demands whatsoever for the purposes described.
