ORDINANCE NO. 97- 32 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING A CONTRACT WITH <br />BURTON SCOT CORPORATION FOR <br />THE IMPROVEMENT OF THE MAYFIELD VILLAGE <br />DETENTION BASIN LOCATED ON <br />THE MAYFIELD HIGH SCHOOL PROPERTY IN <br />THE AMOUNT OF $88,620.00 <br />WHEREAS, it has been deemed necessary to improve the Mayfield Village <br />Detention Basin located at the Mayfield High School, pursuant to the recommendations of <br />the Village Engineer; and <br />WHEREAS, pursuant to law, bids were advertised by the Village, those bids were <br />received, and it is determined that the bid of Burton Scot Corporation was the best bid <br />regarding this improvement and based upon the recommendation of the Village Engineer. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor is authorized and directed to enter into a contract with <br />Burton Scot Corporation with regards to improving the Mayfield Village detention basin <br />located on the Mayfield High School property, pursuant to the bids and specifications as <br />advertised by the Village, and pursuant to that company's bid in the amount of Eighty-Eight <br />Thousand Six-Hundred and Twenty Dollars ($88,620.00), as received by the Village, which <br />is determined to be the best bid and pursuant to the terms and conditions as set forth in <br />these documents, which shall be maintained by the Director of Finance. <br />SECTION 2. The Council finds and determines that all formal actions of this <br />Council relating to the adoption of this Ordinance have been taken at open meetings of <br />this Council; and that deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio, and for the further reasons that time is of the essence both to act to protect <br />and preserve the existing eco-system and with respect to offered acquisition funding. It <br />shall, therefore, take effect immediately upon the passage by the affirmative vote of not <br />less than five (5) members elected to Council and approval by the Mayor or otherwise at <br />the earliest time allowed by law. <br />
