ORDINANCE NO. 97- 34 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />APPROVING AN EASEMENT BETWEEN BETA <br />BUSINESS MALL AND THE CITY OF CLEVELAND <br />FOR THE INSTALLATION AND MAINTENANCE OF A WATER <br />MAIN FOR THE PURPOSE OF SUPPLYING WATER SERVICE <br />WHEREAS, Beta Business Mall is desirous of granting an easement for the <br />installation and maintenance of a water main by the City of Cleveland pursuant to the <br />standard easement of the City of Cleveland, attached hereto and incorporated herein as <br />Exhibit "A"; and <br />WHEREAS, it is Council's desire to accept this easement and to approve same for <br />recording purposes. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor is hereby and herein authorized to accept the <br />easement from the Beta Business Mall as and for the installation and maintenance of water <br />main by the City of Cleveland, for the purpose of supplying water service to the Beta <br />Business Mall property upon the terms and conditions as set forth in Exhibit "A" attached <br />hereto and incorporated herein by reference. <br />SECTION 2. The Council finds and determines that all formal actions of this <br />Council relating to the adoption of this Ordinance have been taken at open meetings of <br />this Council; and that deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio, and for the further reasons that time is of the essence both to act to protect <br />and preserve the existing eco-system and with respect to offered acquisition funding. It <br />shall, therefore, take effect immediately upon the passage by the affirmative vote of not <br />less than five (5) members elected to Council and approval by the Mayor or otherwise at <br />the earliest time allowed by law. <br />%~~~~~ <br />MARK F~'CLER <br />Council President <br />
