ORDINANCE NO. 97- 42 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />CLARIFYING THE MINIMUM'SET BACK REQUIREMENTS <br />BETWEEN THE PROGRESSIVE DEVELOPMENT ON <br />WILSON MILLS AND THE- WORTON PARK SUBDIVISION <br />RESIDENTIAL PROPERTIES <br />WHEREAS, Progressive Corporation has approved an expansion of the ninety foot <br />buffer previously approved by the Village to one hundred ten feet at certain portions along <br />their westerly property line abutting the Worton Park residential subdivision properties; <br />and <br />WHEREAS, the one hundred ten foot minimum set back requirement has not been <br />memorialized in legislation, and such is the purpose of this enactment. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the minimum set back buffer requirement of ninety feet <br />previously approved by legislation, has been increased to one hundred ten feet by <br />agreement between the Village and the Progressive Corporation, providing for a one <br />hundred ten foot buffer between the Progressive buildings or uses and the rear or <br />easterly property lines of the Worton Park residential properties, and that such one <br />hundred ten foot buffer shall be as indicated in Exhibit "A" attached hereto and <br />incorporated herein by reference. <br />SECTION 2. The Council finds and determines that all formal actions of this <br />Council relating to the adoption of this Ordinance have been taken at open meetings of <br />this Council; and that deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio, and for the further reasons that time is of the essence both to act to protect <br />and preserve the existing eco-system and with respect to offered acquisition funding. It <br />shall, therefore, take effect immediately upon the passage by the affirmative vote of not <br />less than five (5) members elected to Council and approval by the Mayor or otherwise at <br />the earliest time allowed by law. <br />
