ORDINANCE NO. 97-43 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING THE PURCHASE OF FOUR SUBLOTS <br />IN THE MIDVALE SUBDIVISION FOR AN AMOUNT <br />NOT TO EXCEED TWENTY-ONE THOUSAND DOLLARS <br />WHEREAS, the Village is desirous of acquiring certain sublots for potential access <br />ways to the Parkview Golf course property; and <br />WHEREAS, the four sublots known as 80, 81, 82 and 83, will provide an avenue <br />for access to the Parkview Golf course property which is being newly acquired by the <br />Village. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor and Director of Finance are hereby and herein <br />authorized and directed to enter into a purchase agreement, and to accept the four <br />parcels known as Permanent Parcel Nos. 831-05-032, 831-05-033, 831-05-034, and 831- <br />05-035, a detailed legal description of same being attached hereto and incorporated <br />herein by reference. <br />SECTION 2. The Director of Finance is authorized to make payment for an <br />amount not to exceed Twenty-One Thousand Dollars ($21,000.00) as and for the <br />purchases in Section 1. <br />SECTION 3. The Council finds and determines that all formal actions of this <br />Council relating to the adoption of this Ordinance have been taken at open meetings of <br />this Council; and that deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio, and for the further reasons that time is of the essence both to act to protect <br />and preserve the existing eco-system and with respect to offered acquisition funding. It <br />shall, therefore, take effect immediately upon the passage by the affirmative vote of not <br />less than five (5) members elected to Council and approval by the Mayor or otherwise at <br />the earliest time allowed by law. <br />
