ORDINANCE NO. 97-43 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE AUTHORIZING THE PURCHASE OF FOUR SUBLOTS IN THE MIDVALE SUBDIVISION FOR AN AMOUNT NOT TO EXCEED TWENTY-ONE THOUSAND DOLLARS WHEREAS, the Village is desirous of acquiring certain sublots for potential access ways to the Parkview Golf course property; and WHEREAS, the four sublots known as 80, 81, 82 and 83, will provide an avenue for access to the Parkview Golf course property which is being newly acquired by the Village. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That the Mayor and Director of Finance are hereby and herein authorized and directed to enter into a purchase agreement, and to accept the four parcels known as Permanent Parcel Nos. 831-05-032, 831-05-033, 831-05-034, and 831- 05-035, a detailed legal description of same being attached hereto and incorporated herein by reference. SECTION 2. The Director of Finance is authorized to make payment for an amount not to exceed Twenty-One Thousand Dollars ($21,000.00) as and for the purchases in Section 1. SECTION 3. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 4. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio, and for the further reasons that time is of the essence both to act to protect and preserve the existing eco-system and with respect to offered acquisition funding. It shall, therefore, take effect immediately upon the passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law.
