3.31 Trimming of Trees <br />(1) Penmittee shall have the authority to trim trees, in accordance with all applicable Utility <br />restrictions, ordinance and easement restrictions, upon and hanging over Streets, alleys, sidewalks, <br />and public places of the Village so as to prevent the branches of such trees from coming in contact <br />with the wires and cables of Permittee at its sole cost. Village representatives shall have authority <br />to supervise and approve all trimming of trees conducted by Permittee. <br />(2) Except in emergencies, Permittee may not prune trees at a point below 30 feet above <br />sidewalk grade until one week after written notice has been given to the owner or occupant of the <br />premises abutting the Street in or over which the tree is growing. For purposes of this Section, <br />emergencies exist when it is necessary to prune to protect the public from imminent danger of <br />immediate interruption of cable signal. The owner or occupant shall have seven (7) days from the <br />receipt of Permittee's notice to arrange for an outside contractor to prune the tree at his or her own <br />expense. If the owner or occupant fails to do so, Permittee may prune such tree at its own expense. <br />3.32 Use of Facilities by Village <br />The Village shall have the right to install and maintain, free of charge, upon the poles and <br />within the underground pipes and conduits of Permittee, any wires and fixtures desired by the Village <br />to the extent that such installation and maintenance does not unreasonably interfere with existing <br />operations of Permittee and are in accordance with other governmental regulations. <br />Section 4. ADMINISTRATION AND REGULATION. <br />4-1 Authority <br />The Village expressly reserves, and the Permittee expressly recognizes the Village's right and <br />duty to adopt, from time to time, in addition to the provisions herein contained, such Charter <br />provisions, resolutions, ordinances and rules and regulations as may be deemed necessary by the <br />Village in the lawful exercise of its police power for the protection of the health, safety and welfare <br />of its citizens and their properties. The Charter and Codified Ordinances of the Village, as the same <br />may be amended from time to time, are expressly incorporated, as if fully set out herein, by this <br />reference. The Permittee shall comply with all Charter provisions, resolutions, ordinances, rules and <br />regulations of the Village and shall obtain all required permits. All Permittees who are also <br />Franchisees under a Cable Television Franchise granted by the Village shall further comply with all <br />requirements contained in the Cable Franchise Agreement and the Master Cable Televison Regulatory <br />Ordinance. Any failure of the Permittee to comply with the requirements of the Village described <br />herein shall constitute an evasion of obligations under this Permit, and shall be prohibited. The <br />Village reserves the right to delegate any of its rights or obligations under this Permit without the <br />consent of the Permittee to any Person, organization or official. <br />19 <br />
