RESOLUTION NO. 97-19 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN RESOLUTION <br />REQUESTING THE CUYAHOGA COUNTY TREASURER <br />TO ADVANCE FROM THE PROCEEDS OF TAX LEVIES <br />FOR THE COLLECTION YEAR 1998 <br />WHEREAS, Section 321.34 of the Ohio Revised Code provides that money in the <br />County Treasury to the credit of the account of a local authority and lawfully applicable <br />to the purpose of the current fiscal year, may be withdrawn by a municipality upon the <br />proper request; and <br />WHEREAS, the Council has found and determined that sound fiscal policy requires <br />that such withdrawal be requested from Cuyahoga County Auditor and the Cuyahoga <br />County Treasurer. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. The Cuyahoga County Auditor be and is hereby requested to draw <br />warrants and the Treasurer of Cuyahoga County be and is hereby requested to pay the <br />Village of Mayfield all monies presently being held in the Cuyahoga County Treasury to <br />the account of the Village of Mayfield, lawfully applicable to the purpose of the fiscal year <br />of 1998. <br />SECTION 2.. The Clerk is hereby authorized and directed immediately to forward <br />a copy of this Resolution to the Cuyahoga County Auditor and the Cuyahoga County <br />Treasurer. <br />SECTION 3. The Council finds and determines that all formal actions of the <br />Council relating to the adoption of this Resolution have been taken at open meetings of <br />this Council; and that deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Resolution is hereby declared to be an emergency measure <br />necessary for the immediate preservation of the health, safety and welfare of the <br />residents of Mayfield Village. It shall, therefore, take effect immediately upon passage <br />by the affirmative vote of not less than five (5) members elected to Council and approval <br />by the Mayor or otherwise at the earliest time allowed by law. <br />ARK FIXLER, <br />Council President
