ol:/zz/9o -:. ~ _~, ORDINANCE N0. 90-2 INTRODUCED BY: Mayor Carmen and Council as a Whole AN ORDINANCE ENACTING NEW SECTION 1377.01 PERTAINING TO THE INSTALLATION OF SMOKE DETECTORS IN RESIDENTIAL DWELLINGS, REPEALING EXISTING SECTION 1377.01 OF THE CODIFIED ORDINANCE OF HAYFIELD VILLAGE, OHIO, AND DECLARING AN EMERGENCY BE IT ORDAINED BY THE COUNCIL. OF HAYFIELD VILLAGE, OHIO, THAT: Chapter 1377 Smoke Detectors See Amended Copy SECTION 1. There is hereby enacted new Section 1377.01 of the Codified Ordinances of Mayfield Village, Ohio, which shall read as follows: 1377.01 Compliance Requirements. (a) It shall be the responsibility of the owner of each new residential construction to ,install smoke detectors in each dwelling unit as hereinafter provided, effective immediately. (b) It shall be the responsibility of the owner of all existing multi-family (excluding condominium units) dwelling units to install smoke detectors in each dwelling unit hereinafter provided, effective immediately. (c) At every change of occupancy of every dwelling unit occa- sioned by or incidental to a sale, lease, or sublease of such unit, it shall be the duty of the grantor thereof (i.e. the seller. landlord, lessor, or sublessor, as the case may be) to certify, before occupancy, to the new occupant that all smoke detectors as required by this Chapter, are installed and in proper working condition. This section shall not be construed to vitiate or render void any contract, lease or sublease subject hereto. (d) When alterations, repairs or additions requiring a permit occur, or when one or more sleeping rooms are added or created in existing dwellings, smoke detectors shall be installed by the owner pursuant to this Chapter. SECTION 2. Existing Section 1377.01 is hereby repealed in its entirety. SECTION 3. All prior Ordinances inconsistent with this Ordinance, in whole or in part, are hereby repealed to the extent necessary to avoid conflict with this Ordinance.
