ol:/zz/9o <br />-:. ~ <br />_~, <br />ORDINANCE N0. 90-2 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />AN ORDINANCE <br />ENACTING NEW SECTION 1377.01 PERTAINING TO THE <br />INSTALLATION OF SMOKE DETECTORS IN RESIDENTIAL DWELLINGS, <br />REPEALING EXISTING SECTION 1377.01 OF THE <br />CODIFIED ORDINANCE OF HAYFIELD VILLAGE, OHIO, <br />AND DECLARING AN EMERGENCY <br />BE IT ORDAINED BY THE COUNCIL. OF HAYFIELD VILLAGE, OHIO, THAT: <br />Chapter 1377 <br />Smoke Detectors <br />See Amended Copy <br />SECTION 1. There is hereby enacted new Section 1377.01 of the Codified <br />Ordinances of Mayfield Village, Ohio, which shall read as follows: <br />1377.01 Compliance Requirements. <br />(a) It shall be the responsibility of the owner of each new <br />residential construction to ,install smoke detectors in each <br />dwelling unit as hereinafter provided, effective immediately. <br />(b) It shall be the responsibility of the owner of all existing <br />multi-family (excluding condominium units) dwelling units to <br />install smoke detectors in each dwelling unit hereinafter <br />provided, effective immediately. <br />(c) At every change of occupancy of every dwelling unit occa- <br />sioned by or incidental to a sale, lease, or sublease of such <br />unit, it shall be the duty of the grantor thereof (i.e. the <br />seller. landlord, lessor, or sublessor, as the case may be) to <br />certify, before occupancy, to the new occupant that all smoke <br />detectors as required by this Chapter, are installed and in <br />proper working condition. This section shall not be construed <br />to vitiate or render void any contract, lease or sublease <br />subject hereto. <br />(d) When alterations, repairs or additions requiring a permit <br />occur, or when one or more sleeping rooms are added or created <br />in existing dwellings, smoke detectors shall be installed by the <br />owner pursuant to this Chapter. <br />SECTION 2. Existing Section 1377.01 is hereby repealed in its entirety. <br />SECTION 3. All prior Ordinances inconsistent with this Ordinance, in <br />whole or in part, are hereby repealed to the extent necessary to avoid <br />conflict with this Ordinance. <br />
