__ ORDINANCE N0. 90-4 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />AN ORDINANCE <br />ENACTING NEW CHAPTER 751 OF THE CODIFIED ORDINANCES <br />HAYFIELD VILLAGE, PERTAINING TO THE SALE OF <br />TRRADIATED FOODS AND DECLARING <br />AN EMERGENCY <br />WHEREAS, the Federal Drug Administration has permitted the radiation of <br />food using radioactive sources including x-rays, electron beams and gamma <br />rays; and <br />WHEREAS, such treatment of food has not all together been demonstrated to <br />be without harmful or hazardous ,effects upon human consumption; and <br />WHEREAS, other states have undertaken legislation to prohibit the sale of <br />irradiated foods within their borders; and <br />WHEREAS, the pronounced primary purpose of such radiation treatment of <br />foods is extension of shelf live without any apparent health benefit for <br />consumers; and <br />WHEREAS, significant studies exist that strongly indicate that irradia- <br />tion of foods constitutes a danger to human health because of the creation of <br />carcinogens and other factors; and <br />WHEREAS, it is in the best interest of all citizens of the Mayfield <br />Village that the use of radiation for treating foods should not be permitted <br />until such time as there is clear and convincing evidence that there is no <br />harmful effect upon the health of our citizens; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. There is hereby enacted Chapter 749 of the Codified Ordinanc- <br />es of Mayfield Village, Ohio, which shall read as follows: <br />Chapter 749 <br />SALE OF IRRADIATED FOODS <br />749.01 DEFINITIONS: <br />(a) "Food" means fruits, vegetables, meats, poultry, eggs <br />
