ORDINANCE N0. 90-7 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />AN ORDINANCE <br />REPEALING ORDINANCE N0.89-42 PERTAINING <br />TO THE LOT AREA PER FAMILY IN A <br />CLASS A-3 DISTRICT, AND <br />DECLARING AN EMERGENCY <br />WHEREAS, the Council of Mayfield Village, Ohio, on January 22, 1990, <br />enacted Ordinance No. 89-42; and <br />WHEREAS, Ordinance No. 89-42 increased the lot area required for <br />two-family dwellings and apartment houses in a Class A-3 District; and <br />WHEREAS, Ordinance No. 89-42 was to be submitted to the electors at he <br />next regular scheduled Primary Election to be held in the Municipality, to <br />wit: May 8, 1990; and <br />WHEREAS, the Council has reconsidered its position and now wishes to <br />• repeal Ordinance No. 89-42 in order to provide additional time for further <br />study of the issue of land use throughout the Village; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. Ordinance No. 89-42, enacted by the Council of Mayfield <br />Village, Ohio, on January 22, 1990, is hereby repealed in its entirety. <br />SECTION 2. The Council finds and determines that all formal actions of <br />this Council relating to the adoption of this Ordinance have been taken at <br />open meetings of this Council; and that deliberations of this Council and of <br />its committees, resulting in such formal action, took place in meetings open <br />to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the health, safety and welfare <br />of the residents of Mayfield Village, Ohio, for the reason that the proposed <br />Ordinance presented must be timely withdrawn from consideration of the elec- <br />torate in accordance with Ohio law. It shall, therefore, take effect immedi- <br />ately upon the passage by the affirmative vote of not less than five (5) <br /> <br />
