02/15/JO ORDINANCE N0. 90~8~~ INTRODUCED BY: Mayor Carmen and Council as a Whole AN ORDINANCE REPEALING ORDINANCE N0. 90-1 SUBMITTING TO THE ELECTORATE OF HAYFIELD VILLAGE, OHIO, ORDINANCE 89-42 THAT AMENDS THE PLANNING AND ZONING CODE OF HAYFIELD VILLAGE, OHIO AND DECLARING AN EMERGENCY WHEREAS, any Ordinance or Resolution .amending or repealing the Planning and Zoning code of Mayfield Village must be approved in compliance with Article III, Section 13, of the Charter of Mayfield Village; and WHEREAS, Ordinance No. 89-42 had been approved in compliance with Article III, Section 13, of the Charter of Mayfield Village; and WHEREAS, such Ordinance was to be submitted to the electors at the next regular scheduled Primary Election to be held in the Municipality more than sixty (60) days after the approval of such Ordinance by Council to wit: May 8, 1990; and WHEREAS, the Ordinance 90-1 prescribed. the manner that Ordinance No. 89-42 would have been submitted to the electorate of Mayfield Village; and WHEREAS, the Council has reconsidered its. position and now wishes to repeal Ordinance 90-1 in order to provide additional time for further study of the issue of land use throughout the Village; now, therefore BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. Ordinance No. 90-1, enacted by the Council of Mayfield Village, Ohio, on January 22, 1990, is hereby repealed in its entirety. SECTION 2. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal, action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.
