Ch. 339 <br />341.01 DEFINITIONS. <br />As used in this chapter of the Traffic Code: <br />(a) "Commercial car" means any motor vehicle having motor power designed <br />and used for carrying merchandise or freight, or used as a commercial <br />tractor. <br />(b) "Commercial tractor", except as defined in Section 301.02, means any motor <br />vehicle having motive power designed or used for drawing other motor vehicles, <br />or designed or used for drawing another motor vehicle while carrying a portion <br />of such other motor vehicle or its load, or both. <br />(c) "Owner" includes any person, firm or corporation other than a manufacturer <br />or dealer having title to a motor vehicle. <br />(ORC 4501.01) <br />341.02 PERMITTING OR DRIVII`1G WHILE FATIGUED OR ILL PROHIBITED. <br />(a) No person- shall drive a commercial motor vehicle as defined in Ohio R.C. <br />4506.01 or a commercial car or commercial tractor, as defined herein, while his <br />ability or alertness is so impaired by fatigue, illness or other causes that it is unsafe <br />for him to drive such vehicle. No driver shall use any drug which would adversely <br />affect his ability or alertness. <br />(b) No owner, as defined herein, of a commercial motor vehicle, commercial <br />car or commercial tractor, or a person employing or otherwise directing the driver <br />of such vehicle, shall require or knowingly permit a driver in any such condition <br />described in subsection (a) of this section to drive such vehicle upon any street <br />or highway.
