351.99 TRAFFIC CODE 92 (d) The design and total.. number of parking spaces for the handicapped provided under subsection (a) hereof, shall be determined in accordance with the Ohio Basic Builidng Code as adopted by Section 1329.01 of the Codified Ordinances. (e) (1) As used in this section, "handicapped person" means any person who has lost the use of one or both legs, or one or both arms, who is blind, deaf or so severely handicapped as to be unable to move about without the aid of crutches or a wheelchair, or whose mobility is restricted by a permanent cardiovascular, pulmonary or other handicapping condition. (ORC 4503.44) (2) "Special handicapped license plates" and "parking card" mean any license plates or parking card issued under Ohio R.C. 4503.44, and also mean any substantially similar license plates or parking card issued by a state, district, country or sovereignty with which the Ohio Director of Highway Safety has entered into a reciprocity agreement as authorized by Ohio R.C. 5502. 03, during the time the agreement is in effect. (ORC 4511.69) (f) It shall be an affirmative defense to any offense charged under subsection (c) hereof that the party so charged is handicapped as defined in this section. (g) The violation of any provision of this section shall be a misdemeanor of the third degree. (Ord. 81-59. Passed 11-16-81.) . 351.99 PENALTY. (a) Whoever violates Section 351.03(d), (i), (q) or (s) shall be fined ten dollars ($10.00) if such fine is paid within forty-eight hours after such violation. (bj Whoever violates Section 351.03(d), (i), (q). or (s) shall be fined twenty dollars ($20.00) if such fine is paid after forty-eight hours and before seventy-two hours after such violation. (c) Whoever violates any provision of Title Seven of the Traffic Code for which no other penalty is provided shall be fined three dollars ($3.00) if paid within forty-eight hours after such violation. (d) Whoever violates any provision of Title Seven of the Traffic Code for which no other penalty is provided shall be fined five dollars ($5.00) if paid after forty-eight hours and before seventy-two hours after such violation. (e) Any person, firm or corporation charged with a violation of any provision of this chapter for which payment of a prescribed fine may be made, may pay such sum in the manner prescribed on the issued traffic ticket. Such payments shall be deemed a plea of guilty, waiver of court appearance and acknowledgment of conviction of the alleged offense and may be accepted in full satisfaction of the prescribed penalty for such alleged violation. Payment of the prescribed fine need not be accepted when laws provide that a certain number of such offenses shall require a court appearance. (Ord. 76-16. Passed 6-21-76.) 1990 Replacement
