04/16/90 <br />ORDINANCE N0. 90-19 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />AN ORDINANCE <br />ENACTING NEW SECTION 521.081 OF <br />THE CODIFIED ORDINANCES OF HAYFIELD VILLAGE., OHIO, <br />PROHIBITING POLLUTION OF WATERWAYS AND <br />DECLARING AN EMERGENCY <br />BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. Section 521.081 of the Codified Ordinances of Mayfield. <br />Village, Ohio, is hereby enacted to prohibit the pollution of waterways within <br />the Municipality so that New Section 521.081 should. read as follows: <br />Chapter 521 <br />Health, Safety and Sanitation <br />Section 521.081 Pollution of Waterways. <br />(a) No person shall place or dispose or permit to be <br />placed or disposed, any sewage, waste, refuse <br />of filthy drainage into any lake,. pond, streams, <br />ditch, drain or watercourse, or on or in any places <br />from which it may run or wash therein. <br />(b) Whoever violates this section is guilty of a <br />misdemeanor of the first degree. <br />SECTION 2. The Council finds and determines that all. formal actions of <br />this Council relating to the adoption of this Ordinance have been taken at <br />open meetings of this Council; and that deliberations of this Council and of <br />its committees, resulting in such formal action, took place in meetings open <br />to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the health, safety and welfare <br />of the residents of Mayfield Village., Ohio, for the reason. that such. <br />legislation is mandatory to protect the environment within the Municipality. <br />It shall, therefore, take effect immediately upon the passage by the <br />
