ORDINANCE N0. 90-21 <br />Page -5- <br />1127.08 Variance. <br />The Village Council may grant a variance to these regulations where <br />the owner or his appointed representative can show that a hardship <br />exists whereby compliance with these regulations is not appropriate, <br />based upon the following: <br />(a) That exceptional topographic or other physical conditions <br />exist which are peculiar to the particular parcel of land; <br />(b) that the peculiar condition in paragraph (a) did not result <br />from previous actions by the owner; <br />Adverse economic conditions shall not be considered as a valid <br />reason or a hardship for a variance request to be granted. No <br />variances will be granted where activities occur that will defeat <br />the purposes of regulations. <br />The request for a variance shall be submitted to Village Council <br />with a copy to the Village Engineer and shall state the specific <br />variances sought and include sufficient data to justify the granting <br />of a variance. <br />1127.09 Penalty. <br />Whoever shall violate the provisions of this Chapter shall be guilty <br />of a misdemeanor of the first degree. Punishment shall be as <br />provided in Section 501.99 of the General Offenses Code. Each day <br />during or on which a violation continues shall constitute a separate <br />offense <br />SECTION 2. The Council. finds and determines that all formal actions of <br />this Council relating to the adoption of this Ordinance have been taken at <br />open meetings of this Council; and that deliberations of this Council and of <br />its committees, resulting in such formal action, took place in meetings open <br />to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared. to be an emergency measure <br />immediately necessary for the health, safety and welfare. of the residents of <br />Mayfield Village, Ohio, for the reason that it is immediately necessary to <br />adopt this new Chapter to provide for the orderly development of Mayfield <br />Village. It shall, therefore, take effect immediately upon the passage by the <br />
