ORDINANCE N0. 90-29 <br />Page -2- <br />newspaper of general circulation within the Municipality, if notice <br />cannot be served in any other matter provided herein . <br />(d) When the cause or source of a nuisance exists on property owned by <br />the Municipality, the Building Commissioner/Service Director shall <br />abate the nuisance at the expense of the Municipality. No notice <br />shall be required preliminary to the abatement. <br />SECTION 2. All. prior Ordinances. inconsistent with this Ordinance, in <br />whole or in part, are repealed to the extent. necessary to avoid conflict with <br />this Ordinance. <br />SECTION 3. The Council finds and determines that all formal actions of <br />this Council relating to the adoption of this Ordinance have been taken at <br />open meetings of this Council; and that deliberations of this Council and. of <br />its committees, resulting in such formal action, took place in meetings open <br />to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />_' SECTION 4. This Ordinance is hereby declared to be an emergency measure <br />^ immediately necessary for the health, safety and welfare of the residents of <br />Mayfield Village, Ohio, for the reason that such legislation is needed to <br />abate of a nuisance condition within the Municipality. It shall, therefore, <br />take effect immediately upon the passage by the affirmative vote of not less <br />than five (5) members elected to Council and approval by the Mayor or <br />otherwise at the earliest time allowed. by 1 w. <br />LILL AN M.
