ORDINANCE 90-44 <br />Page 4 <br />incinerator for which application for construction is made on or <br />after the effective date of this section (Ordinance NO. 90-44, <br />passed November 19, 1990). <br />1345.06 MAINTENANCE AND REMOVAL OF EXISTING INCINERATORS. <br />All existing incinerators shall be maintained and in a safe <br />working condition, free of structural defects and fire code <br />violations so as to not constitute a safety hazard. Incinerators <br />which no long serve the purpose for which they were intended or <br />which have been abandoned or not maintained in accordance with <br />this section, and other applicable regulations in the <br />Municipality, shall be removed by the person on whose premises <br />such incinerator is contained. <br />1345.07 DISPOSER PERMIT: Fee: Application: <br />(a) No person shall install a mechanical garbage disposal <br />without first having obtained a permit therefor from the Building <br />Commissioner. The fee for such permit shall be as provided in <br />Chapter 1309. <br />(b) The application for such permit shall contain such <br />information as the Building Inspector prescribes and I will <br />assist him determining whether the proponents relation meets <br />requirements of this chapter. Such application and permit may be <br />submitted and issued separately or may be combined with the <br />plumbing application and permit. However, such application and <br />permit must show the type, model number, manufacturer of such <br />disposal or some other means for identifying such disposer. If <br />the application for and the issuance of such permit is so <br />combined the fee provided in Subsection (a) hereof shall be in <br />addition to all other fees or charges required. <br />1345.08 INSPECTION AUTHORITY. <br />The Building Commissioner, or his duly authorized representative, <br />shall have the authority to enter and inspect building and <br />premises for the purposes of enforcing this chapter. <br />1345.99 PENALTY. <br />Who ever violates any provision of this chapter shall be <br />fined not more than one hundred dollars ($100.00) for each <br />violation. Each day during or on which the violation occurs or <br />continues shall constitute a separate offense. <br />SECTION 2. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this <br />Ordinance have been taken at open meetings of this Council; and <br />that deliberations of this Council and of its committees, <br />resulting in such formal action, took place in meetings open to <br />the public, in compliance with all statutory requirements <br />
