Amended 5/7/90 <br />RESOLUTION N0. 90-17 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />A RESOLUTION <br />DECLARING TERRA CONSTRUCTION COMPANY <br />AS THE LOWEST AND BEST BIDDER FOR THE PURPOSE <br />OF DEFINING AND IMPROVING A DRAINAGE CHANNEL <br />NORTH OF HIGHLAND ROAD, CONDITIONALLY <br />AUTHORIZING THE. MAYOR AND PRESIDENT OF COUNCIL <br />TO EXECUTE A CONTRACT WITH SAID BIDDER, <br />REJECTING ALL OTHER BIDS RECEIVED <br />AND DECLARING AN EMERGENCY <br />BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. In accordance with bids received, pursuant to advertisement <br />as required by Ohio law, Terra Construction Company is hereby declared to be <br />the lowest and best bidder for the purpose of defining and improvement of the <br />drainage channel North of Highland Road. <br />SECTION 2. The Mayor and President of Council are hereby authorized and <br />directed to enter into a contract with said bidder in the amount not to exceed. <br />Thirteen Thousand Two Hundred Dollars ($13,200.00) provided that said contract <br />is in accordance with the specifications upon which the bid was received. <br />SECTION 3. The acceptance of such bid and authorization to execute such <br />contract is conditioned on the municipality receiving by April 24, 1990, <br />executed temporary right-of-entries as approved by the Law Director from the <br />adjacent property owners to wit: John and Phyliss Norbo, Mervin and Mary <br />Singer and Sunrise Land Development Company. <br />SECTION 4. All other bids received are hereby rejected. <br />SECTION 5. The Council finds and determines that all formal actions of <br />this Council relating to the adoption of this Resolution have been taken at <br />open meetings of this Council; and that deliberations of this Council and of <br />its committees, resulting in such formal. action, took place in meetings open <br />to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 6. This Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the health, safety and welfare <br />of the residents of Mayfield Village, Ohio, for the reason that the purchase <br />authorized herein is necessary to maintain effective drainage throughout the <br />municipality.
