03/19/90 <br />~~~ RESOLUTION N0. 90- 21 <br />INTRODUCED BYc Mayor Carmen and Council as a Whole <br />A RESOLUTION <br />URGING SUPPORT FOR THE CITY OF <br />MIDDLEBURG HEIGHTS IN ITS EFFORT <br />TO PREVENT PRIVATE DEVELOPERS FROM BUILDING <br />MULTIFAMILY BUILDINGS WITHOUT ADEQUATE FIRE WALLS <br />WHEREAS, the City of Middleburg Heights Code requires multifamily build- <br />ings to have "fire walls" constructed of masonary block to prevent the spread <br />of fire from unit to unit within a multifamily structure; and <br />WHEREAS, private developers have persuaded the State Board of Building <br />Standards that State of Ohio Basic Building Code allows "fire separations" <br />constructed of wood and dry wall in three story multifamily buildings; and <br />WHEREAS, private developers contend that it is cheaper to construct <br />multifamily buildings with a "fire separation" made of wood and dry wall <br />rather that a "fire wall" constructed of masonry block, while ignoring the <br />;• fact that actual and potential long term costs of this cheaper construction <br />_, are greater to the community; and <br />WHEREAS, the Council and Mayor of Middleburg Heights believe that the <br />"fire separations" are inadequate to prevent loss of life and economic loss <br />that would be prevented by "fire walls"; and <br />WHEREAS, the Ohio Board of Building Standards, a non-elected state board, <br />has attempted to punish the city of Middleburg Heights by decertifying its <br />building department because the City of Middleburg Heights requires "fire <br />walls"; and <br />WHEREAS, the City of Middleburg Heights has appealed said order to the <br />Franklin County Common Pleas Court where it is now pending; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THATe <br />SECTION 1. That the Mayor and Council of Mayfield Village hereby urge <br />the Ohio State Legislature to pass legislation which would prevent the Board <br />of Building Standards from interfering with Municipal fire regulations that <br />protect the citizens from loss of life and/or property. <br />
