RESOLUTION N0. 90-29 INTRODUCED BY: Mayor Carmen and Council as a Whole A RESOLUTION DECLARING THE A & J CEMENT CONTRACTORS, INC. TO BE LOWEST AND BEST BIDDER. FOR THE RECONSTRUCTION OF CERTAIN STREETS WITHIN THE MUNICIPALITY, AUTHORIZING THE MAYOR AND PRESII?ENT OF COUNCIL TO EXECUTE.A CONTRACT WLTH THE_A & J CEMENT CONTRACTORS, INC. IN AN AMOUNT NOT TO EXCEED ONE HUNDRED SEVENTEEN. THOUSAND EIGHT. HUNDRED EIGHTY DOLLARS ($117,880.00), REJECTING ALL OTHER BIDS RECEIVED AND DECLARING AN EMERGENCY BE IT RESOLVED BY THE. COUNCIL OF HAYFIELD VILLAGE, OHIO,. THAT: SECTION 1: In accordance with. bids received pursuant to advertisement as required by law, the A & J Cement Contractors, Inc. is hereby declared to be the lowest and best bidder for the reconstruction.of certain streets within the Municipality. SECTION 2. The Mayor and President- of Council. are hereby authorized and directed to execute a contract with the A & J Cement Contractors, Inc. in an amount not to exceed. One Hundred Seventeen Thousand Eight Hundred Eighty Dollars ($117,880.00) for the aforesaid project provided that said contract is in accordance with the specifications upon which the bid was received. SECTION 3. All other bids received are. hereby rejected.. SECTION 4. The Council finds and determines that all. formal actions of this Council relating to the adoption of this Reso ution have been taken at open meetings `of this Council; and that deliberations of this Council-and of its committees, resulting in such formal action, took place in meetings open. to the public, in compliance with all statutory requirements including the requirements of Section 121..22 of the_Ohio Revised Code. SECTION 5. This Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the health and welfare of the residents of Mayfield Village,. Ohio, for the reason. that the contract author- ized herein is necessary to maintain an effective street repair program. within the Municipality to provide. for safe vehicular traffic. It shall., therefore, take effect immediately upon the passage by the affirmative vote of not less.
