RESOLUTION N0. 90 30 <br />INTRODUCED BY: Mayor Carmen and Council. as a Whole <br />A RESOLUTION <br />DECLARING THE. PAVEMENT TECHNOLOGY, INC. <br />TO BE THE LOWEST AND BEST BIDDER FOR THE SEALING OF <br />ASPHALT ROAD SURFACES WITHIN THE MUNICIPALITY, <br />AUTHORIZING THE MAYOR AND PRESIDENT OF GOUNCIh TO <br />EXECUTE A CONTRACT WITH. THE PAVEMENT TECHNOLOGY, INC. <br />IN AN AMOUNT NOT TO EXCEED TWENTY SEVEN THOUSAND <br />NINE HUNDRED FIFTY DOLLARS ($27,950.00), REJECTING ALL <br />OTHER BIDS RECEIVED AND <br />DECLARING AN EMERGENCY <br />BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. In accordance with bids received. pursuant to advertisement as <br />required by law, the Pavement Technology, Inc. is hereby declared. to be the <br />lowest and best bidder for the sealing. of asphalt. road. surfaces. within the <br />Municipality. <br />SECTION 2. The Mayor and President of Council are hereby authorized and <br />directed to execute a contract. with the Pavement Technology, Inc. in an amount. <br />not the exceed Twenty Seven Thousand Nine Hundred. Fifty Dollars ($27,950.00) <br />for the aforesaid project provided that said contract is in accordance with <br />the specifications upon which the bid. was received. <br />SECTION 3. All other bids. received. are hereby rejected.. <br />SECTION 4. The Council finds and determines that all formal actions of <br />this Council relating. to the adoption of this Resolution have been. taken at <br />open meetings of this Council; and that deliberations of this Council and of <br />its committees, resulting in such. formal action, took place in meetings open <br />to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised. Code... <br />SECTION 5. This Resolution is hereby declared to be an emergency measure <br />immediately necessary the for preservation of the health, safety and welfare <br />of the residents of Mayfield Village, Ohio, for the reason. that the contract <br />authorized. herein is necessary to maintain an effective maintenance program <br />within the Municipality to provide for safe vehicular. traffic. It shall, <br />therefore, take. effect immediately upon the passage by the affirmative vote of <br />
