..~_ ._ C O O P E R A T I O N <br />A G R E E M E N T <br />This agreement made and entered into this day of <br />by and between the Political Subdivision of <br />the VILLAGE OF HAYFIELD Ohio, by its Chief Executive <br />Officer, duly authorized by ordinance No. passed by <br />its Council on the day of 19 _ , <br />(hereinafter referred to as "Political Subdivision"), and the <br />County of Cuyahoga, Ohio, duly authorized by a resolution adopted <br />by its Board of County Commissioners on the day <br />of 19 (hereinafter referred to as <br />"County" <br />WITNESSETH <br />WHEREAS, the Housing and Community Development Acts of 1974, <br />1977, 1980, 1983 and 1987 as amended, provides an entitlement of <br />Community Development Black Grant (CDBG) funds for Community <br />Development purposes for Urban Counties; and <br />WHEREAS, Cuyahoga County may be designated as an Urban County <br />provided that it secures Cooperation Agreements with various <br />Political Subdivisions in Cuyahoga County; and <br />WHEREAS, the Chief Executive <br />of the Political Sttbdivisioti of <br />desires the use of "Urban COLlllt <br />public improvements in Cuyahoga <br />Officer and the Legislative Body <br />the VILLAGE OF HAYFIELD <br />y Entitlement Funds" for needed <br />County and its municipalities; and <br />WHEREAS, the County shall prepare Application for FY '91, '92, <br />& '93 Urban County CDBG funds and Program Income generated from the <br />expenditure of CDBG funds pursuant to the aforementioned Act for <br />the FY '91, '92, AND '93 Program Years; and <br />WHEREAS, no less than forty percent (40~;) of the total Urban <br />County Entitlement Funds for Cuyahoga County will be expended by <br />the Cuyahoga County Board of Commissioners on behalf of the <br />participating political subdivisions to finance through a Municipal <br />Grant Program eligible Community Development activities, programs, <br />and projects in said participating political subdivisions; and <br />NOW, THEREFORE, the Political Subdivision and the County do <br />hereby promise and agree; <br />The County will on behalf of the Political Subdivision execute <br />essential Community Development and Housing Assistance <br />applications, plans, and programs, and projects eligible under the <br />Housing and Community Development Acts of 1974, 1977, 1980, 1983 <br />and 1987 as amended, and the County and the Political Subdivision <br />agree to "Cooperate to undertake, or assist in undertaking, <br />community renewal and lower income housing assistance activities, <br />specifically urban renewal and publicly assisted housing", as <br />approved by the Supreme Court of Ohio in Bursetle V. Rich, 159 O.S. <br />13, pLlrStldllt to the Application, and publicly assisted housing <br />ptlrslldllt to the Application. <br />The Cottnty and Political Subdivision will take all the actions <br />necessary to comply with the provisions of section 104 (b) of Title <br />I of the Housing and Community Development Act of 1974, as amended, <br />of the National Environmental Policy Act of 1969, Title VI of the <br />Civil Rights Act of 1964, Title VIII of the Civil Rights Act of <br />1968, Executive Order 11988, the Fair Housing Act, Section 109 of <br />['itle I of the Housing and Community Development Act of 1974 as <br />amended, and other applicable laws. <br />
