<br />i. <br />AGREEMENT <br />~~ ~~ <br />~r~ <br />c <br />~~, C <br />. ~ ~~ <br />!w ~~ <br />~l' <br />' WHEREAS, the Ohio Municipalities of Lyndhurst, Mayfield <br />Heights, Gates Mille, 'Mayfield Village, Highland Heights, and <br />Richmond Heights desire to enter into an Agreement which. sets <br />forth the terms, conditions, rights obligations and duties of <br />each~of the Municipalities relevant to establishment of a <br />cooperative venture among said Municipalities for the development <br />of a Mobile Air Unit; and <br />WHEREAS, the aforesaid Munici;~~l.ities desire to develop the <br />Mobile Air Unit to meet the needs of each of the aforesaid <br />Municipalities with regard to the availability and use of said <br />Unit;. and <br />WHEREAS, to the extent that tt~e terms, conditions, rights, <br />obligations and duties of the aforesaid I~iunicipalii:ies can be <br />determined at this time, t}ie Municipalities enter into this <br />Agreement with the understanding that any terms, conditions, <br />rights, obligations and duties not specifically set forth herein <br />are subject to further agreement between the Municipalities but <br />that in any such'supplemental agreement the spirit and intent of <br />this Agreement shall be carried out. <br />NOW, THEREFORE,_the undersigned Municipalities agree <br />that: <br />1. The Municipalities of Lyndhurst, Mayfield Heights, <br />Gates Mills, Mayfield Village, Highland Heights, and <br />Richmond Heights {"~artiripating Municipalities") do <br />hereby agree to develop a Mobile Air Unit which shall <br />be available to, and used by, the Participating <br />Municipalities :as needed without reference to any <br />particular fc;rmula or, timetable for such availability <br />or use.
