8/20/90 <br />FAILED 2/18/91 <br />RESOLUTION N0. 90-53 <br />INTRODUCED BY: Mayor Carmen & Council as a Whole <br />A RESOLUTION <br />AUTHORIZING THE MAYOR AND PRESIDENT OF COUNCIL <br />TO ENTER INTO A CONTRACT WITH BURGESS & NIPLE, LIMITED <br />TO CONDUCT A STORM WATER MANAGEMENT UTILITY FEASIBILITY STUDY, <br />AUTHORIZING THE DIRECTOR OF FINANCE TO PAY AN AMOUNT <br />NOT TO EXCEED FORTY FIVE THOUSAND DOLLARS ($45,000.00) <br />AND DECLARING AN EMERGENCY <br />WHEREAS, Mayfield Village has determined that its primary goal is to <br />establish a comprehensive Storm Water Management Program that would eliminate <br />existing storm water problems and. meet future storm. water needs; and <br />WHEREAS, Mayfield Village lacks the. funds needed to improve its storm <br />water drainage system beyond incidental cleaning and repairs; and <br />WHEREAS, Mayfield Village is desirous to undertake a feasibility study to <br />determine if a utility method of financing a Storm Water Management Program is <br />the best financing procedure; and <br />WHEREAS, the Council of Mayfield Village is desirous of authorizing a <br />contract with Burgess and Niple, Limited, to conduct a Storm Water Management <br />Unit Feasibility Study; now, therefore, ' <br />BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE,-OHIO, THAT: <br />SECTION 1. The Mayor and President of Council is authorized to execute a <br />contract with the Burgess & Niple, Limited., fora Storm Water Management <br />Utility Feasibility Study in the amount not to exceed Forty Five Thousand <br />Dollars ($45,000.00). <br />SECTION 2. The Director of Finance is hereby authorized and directed <br />to make payment to Burgess & Niple, Limited, for said amount, to wit: <br />Forty Five Thousand. Dollars ($45,000.00). <br />SECTION 3. The Council finds and determines that all formal actions of <br />this Council relating to the adoption of this Resolution have been taken at <br />open meetings of this Council; and that deliberations of this Council and of <br />its committees, resulting in such formal action, took place in meetings open <br />to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4: This Resolution is hereby declared to be an emergency measure <br />necessary for the immediate preservation. of the health, safety and welfare of <br />the residents of Mayfield Village, Ohio, for the reason that such study is <br />T required to establish a comprehensive Storm Water Management Program in the <br />
