9/10/90 <br />RESOLUTION N0. 90-59 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />A RESOLUTION <br />URGING THE OHIO GENERAL. ASSEMBLY TO <br />DECLARE THE SOLID WASTE LANDFILL INDUSTRY <br />TO BE A PUBLIC UTILITY, AND TO CAUSE THE LANDFILL <br />INDUSTRY TO OPERATE UNDER THE DIRECTION OF THE. OHIO <br />PUBLIC UTILITIES COMMLSSION <br />WHEREAS, the generation of solid waste products is a necessary and <br />continuing activity of the people of this community and all other communities <br />in the State of Ohio; and <br />WHEREAS, the number of dumpsites available for the disposition of waste <br />products has been diminishing; and <br />WHEREAS, the remaining locations for the siting of solid waste are in the <br />hands of only a few companies; and <br />fdHE_RF.AS, as a result of these and other conditions., the cost of landfill <br />usage has been escalated beyond the reach of many municipal budgets; and <br />WHEREAS, because of the lack of competition in said industry parallel <br />conditions exist as those found in the electric power, natural gas and tele- <br />communications industries; and <br />WHEREAS, the Ohio Legislature has previously provided for the protection <br />of the people of this. state by creating a Public Utilities Commission,. which <br />regulates the conditions under which these utilities operate; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT:. <br />SECTION 1. The Mayor and Council of Mayfield Village., Ohio urge the <br />General Assembly of the State of Ohio to recognize the solid waste disposal. <br />industry as a public utility, and as such, be subject to the rules and regula- <br />tions of the Public Utilities Commission, State of Ohio. <br />SECTION 2. The Clerk of Council.. is hereby authorized and. directed to <br />forward a copy of this Resolution to Governor Richard F. Celeste, to the <br />entire Cuyahoga County delegation, to the Ohio General Assembly, to the Board <br />
