9/17/70 <br />RESOLUTION N0. 90-60 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />A RESOLUTION <br />AUTHORIZING THE MAYOR AND PRESIDENT OF COUNCIL <br />TO ENTER INTO A CONTRACT WITH THE <br />CITY OF CLEVELAND FOR THE RESPONSE TO <br />HAZARDOUS MATERIAL INCIDENTS AND <br />DECLARING AN EMERGENCY <br />WHEREAS, the City of Cleveland has offered to provide assistance and <br />materials to Mayfield Village when needed for the response to hazardous <br />material incidents within Mayfield Village; and <br />WHEREAS, the Fire Chief of Mayfield Village has recommended that the <br />Village enter into a contract with the City of Cleveland for response to <br />hazardous material incidents; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL. OF HAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. The Mayor and President of Council are hereby authorized and <br />directed to enter into a contract with the City of Cleveland for response to <br />hazardous material incidents in the form and upon the conditions contained in <br />Exhibit "A" attached hereto and incorporated herein as though fully set forth. <br />SECTION 2. The Council finds and determines that all formal actions of <br />this Council relating to the adoption of this Resolution have been taken at <br />open meetings of this Council; and that deliberations of this Council and of <br />its committees, resulting in such formal action, took place in meetings open <br />to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the health, safety and welfare <br />of the residents of Mayfield Village, Ohio, for the reason that it is <br />necessary for the protection of the public from hazardous material incidents. <br />It shall, therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to Council and <br />approval by the Mayor or otherwise at the earliest time allowed by law. <br />First Reading: September 17 1990 <br />Second Reading: September 17 , 1990 <br />Third Reading: September 17 1990 <br />PASSED: _September 17 ~~ 1990 <br />LILLIAN M.
