RESOLUTION NO. 90- 73 INTRODUCED BY: Mayor Carmen and Council as a Whole A RESOLUTION AUTHORIZING A CHANGE ORDER FOR DEFINING AND IMPROVING THE DRAINAGE CHANNEL NORTH OF HIGHLAND ROAD AND DECLARING AN EMERGENCY WHEREAS, pursuant to Resolution 90-17, the Mayfield Village Council authorized a total amount of Thirteen Thousand Two Hundred Dollars ($13,200.00) for the defining and improving of the drainage channel North of Highland Road; and WHEREAS, additional excavating and improvements were necessary at an additional cost of One Thousand Two Hundred Dollars ($1,200.00) that were requested by the Village Engineer in order to maintain effective drainage through such area, now, therefore, BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. The Mayor and President, of Council are hereby authorized to enter into a change order for an additional amount of One Thousand Two Hundred Dollars ($1,200.00) over and above the Thirteen Thousand Two Hundred Dollars ($13,200.00) approved in Resolution 90-17 for a total contract price of Fourteen Thousand Four Hundred Dollars ($14,400.00). SECTION 2. The Council finds and determines that all formal actions of this Council relating to the adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 3. This Resolution is hereby declared to be an emergency measure immediately necessary for the immediate preservation of the health, safety and welfare of the residents of Mayfield Village, Ohio, for the reason of the necessity of entering into a change order with Terra Construction Company, so that adequate funds for the completion of this project are available.
