RESOLUTION NO. 90-80 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />A RESOLUTION <br />REQUESTING THE CUYAHOGA COUNTY TREASURER <br />TO ADVANCE TAXES FROM THE PROCEEDS OF TAX LEVIES <br />FOR COLLECTION YEAR 1991, AND <br />DECLARING AN EMERGENCY <br />WHEREAS, Section 321.34 of the Ohio Revised Code provides <br />that money in a County Treasurer to the account of a local <br />authority and lawfully applicable to the purpose of the current <br />fiscal year may be withdrawn by a municipality upon the proper <br />request; and <br />WHEREAS, the Council has found and determined that sound <br />fiscal policy requires that such withdrawal be requested from the <br />Cuyahoga County Auditor and the Cuyahoga County Treasurer; now, <br />therefore, <br />BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. The Cuyahoga County Auditor be and is hereby <br />requested to draw warrants and the Treasurer of Cuyahoga County <br />be and is hereby requested to pay the Village of Mayfield all <br />monies presently being held in the Cuyahoga County Treasury to <br />the account of the Village of Mayfield, lawfully applicable to <br />the purpose of the fiscal year 1991. <br />SECTION 2. The Clerk be and is hereby authorized and <br />directed immediately to forward a copy of this Resolution to the <br />Cuyahoga County Auditor and the Cuyahoga County Treasurer. <br />SECTION 3. The Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and <br />that deliberations of this Council and of its committees, <br />resulting in such formal action, took place in meetings open <br />to the public, in compliance with all statutory requirements <br />including the requirements of Section 121.22 of the Ohio Revised <br />Code. <br />SECTION 4. This Resolution is hereby declared to be an <br />emergency measure immediately necessary for the health, safety <br />and welfare of the residents of Mayfield Village, Ohio, for the <br />
