1/21/9' <br />RESOLUTION NO. 91-04 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />A RESOLUTION <br />APPROVING THE PRELIMINARY PLAN OF THE <br />VILLAGE TRAILS SUBDIVISION AND <br />DECLARING AN EMERGENCY <br />WHEREAS, Lou Marino, as developer, has heretofore applied <br />to the Planning and Zoning Commission of Mayfield Village for the <br />approval of a preliminary plan and for dedication of streets for <br />the Village Trails Subdivision located off of Wilson Mills Road, <br />east of Hanover Woods; and <br />WHEREAS, the Village Engineer has approved said preliminary <br />plan and the Planning and Zoning Commission has also approved <br />said preliminary plan subject to and conditioned upon the <br />developers compliance with specific requirements relating to the <br />sanitary sewers; and <br />WHEREAS, the Mayor and Council of the Municipality have <br />determined that the subdivision complies with all other <br />applicable provisions of the Codified Ordinances of Mayfield <br />Village, Ohio, pertaining to platting and subdividing procedures; <br />now, therefore,, <br />BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. The Council of Mayfield Village does hereby <br />approve the preliminary plan of a Village Trails Subdivision <br />subject to and conditioned upon the developer's obtaining <br />approval of the Ohio EPA, Northeast Ohio Regional Sewer District <br />and the Cuyahoga County Sanitary Engineering Department relating <br />to the sanitary sewer system through such subdivision. <br />SECTION 2. The Council of Mayfield Village hereby <br />authorizes said developer to proceed with the preparation of the <br />final plat and presents same to the Planning and Zoning <br />Commission together with a certificate indicating compliance with <br />the conditions referred to herein within one (1) year from the <br />date hereof. <br />SECTION 3. The Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and <br />that deliberations of this Council and of its committees, <br />resulting in such formal action, took place in meetings open <br />
