1/21/91 <br />RESOLUTION NO. 91-~~ <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />A RESOLUTION <br />AUTHORIZING THE MAYOR AND PRESIDENT OF COUNCIL <br />TO EXECUTE A CONTRACT WITH THE RING EXCAVATING <br />COMPANY IN THE AMOUNT NOT TO EXCEED SIX THOUSAND DOLLARS <br />($6,000.00) FOR THE PURPOSE OF DEFINING AND IMPROVING <br />BEECHERS BROOK, DECLARING SAID IMPROVEMENTS TO BE <br />A TRUE EMERGENCY AND <br />DECLARING AN EMERGENCY <br />WHEREAS, the Mayor and Council have recently been advised <br />by the Building Commissioner/Service Director that Beechers Brook <br />is in need of immediate improvements in order to prevent further <br />damage to adjacent property owners; and <br />WHEREAS, the aforesaid improvements are of such an urgent <br />nature that unless the same are made, there potentially may be <br />substantial damage to the adjacent property owners; and <br />WHEREAS, the Village has been able to obtain a favorable <br />estimate for such improvements necessary, said estimate for <br />improvements have being obtained from King Excavating Company; <br />now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. The Mayor and President of Council are hereby <br />authorized and directed to enter into a contract with the King <br />Excavating Company in the amount not to exceed Six Thousand <br />Dollars ($6,000.00) for the improvements necessary to Beechers <br />Brook. <br />SECTION 2. The improvements authorized herein is hereby <br />declared to be true emergency immediately necessary to preserve <br />the health, safety and welfare of the residents of Mayfield <br />Village for the reasons set forth in the preamble hereto and the <br />same is, therefore, authorized without the necessity of <br />competitive biding. <br />SECTION 7. The Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and <br />that deliberations of this Council and of its committees, <br />resulting in such formal action, took place in meetings open <br />
