1/21/91 RESOLUTION NO. 91-~~ INTRODUCED BY: Mayor Carmen and Council as a Whole A RESOLUTION AUTHORIZING THE MAYOR AND PRESIDENT OF COUNCIL TO EXECUTE A CONTRACT WITH THE RING EXCAVATING COMPANY IN THE AMOUNT NOT TO EXCEED SIX THOUSAND DOLLARS ($6,000.00) FOR THE PURPOSE OF DEFINING AND IMPROVING BEECHERS BROOK, DECLARING SAID IMPROVEMENTS TO BE A TRUE EMERGENCY AND DECLARING AN EMERGENCY WHEREAS, the Mayor and Council have recently been advised by the Building Commissioner/Service Director that Beechers Brook is in need of immediate improvements in order to prevent further damage to adjacent property owners; and WHEREAS, the aforesaid improvements are of such an urgent nature that unless the same are made, there potentially may be substantial damage to the adjacent property owners; and WHEREAS, the Village has been able to obtain a favorable estimate for such improvements necessary, said estimate for improvements have being obtained from King Excavating Company; now, therefore, BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. The Mayor and President of Council are hereby authorized and directed to enter into a contract with the King Excavating Company in the amount not to exceed Six Thousand Dollars ($6,000.00) for the improvements necessary to Beechers Brook. SECTION 2. The improvements authorized herein is hereby declared to be true emergency immediately necessary to preserve the health, safety and welfare of the residents of Mayfield Village for the reasons set forth in the preamble hereto and the same is, therefore, authorized without the necessity of competitive biding. SECTION 7. The Council finds and determines that all formal actions of this Council relating to the adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open
