RESOLUTION NO. 91-23 INTRODUCED BY: Mayor Carmen and Council as a Whole A RESOLUTION DECLARING D D D ENTERPRISES, INC. TO BE THE LOWEST AND BEST BIDDER FOR THE REMOVAL AND REPLACEMENT OF THE WILSON MILLS ROAD DRAINAGE STRUCTURE IN AN AMOUNT NOT TO EXCEED FIFTY-TWO THOUSAND NINE HUNDRED THIRTY FIVE DOLLARS ($52,935.00), AUTHORIZING THE MAYOR AND PRESIDENT OF COUNCIL TO EXECUTE A CONTRACT WITH THE D D D ENTERPRISES, INC., REJECTING ALL OTHER BIDS RECEIVED AND DECLARING AN EMERGENCY BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. In accordance with bids received pursuant to advertisement as required by law, D D D Enterprises, Inc., is hereby declared to be the lowest and best bidder for the removing and replacing of the Wilson Mills Drainage Structure. SECTION 2. The Mayor and President of Council are hereby authorized and directed to execute a contract with D D D Enterprises, Inc., in an amount not to exceed Fifty-Two Thousand Nine Hundred Thirty-Five Dollars ($52,935.00) provided that such contract is in accordance with the specifications upon which the bid was received. SECTION 3. All .other bids received are hereby rejected. SECTION 4. The Council finds and determines that all formal actions of this Council relating to the adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 5. This Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the health, safety and welfare of the residents of Mayfield Village, Ohio, for the reason that such legislation is necessary for effective drainage of storm water within the Municipality.
