RESOLUTION NO. 91- 44 INTRODUCED BY: Mayor Carmen and Council as a Whole A RESOLUTION ACCEPTING A STANDARD EASEMENT FOR THE INSTALLATION AND MAINTENANCE OF A WATER MAIN FROM VILLAGE TRAILS DEVELOPMENT CO. FOR THE PURPOSE OF SUPPLYING WATER SERVICE IN VILLAGE TRAILS SUBDIVISION NO. 1 (PROPOSED) (Part of Original Mayfield Township Lot 47, Tract 1) WHEREAS, Village Trails Development Co. has submitted to the Village Of Mayfield a Standard Easement for the installation and maintenance of a water main for the purpose of supplying water service in the Village Trails Subdivision No. 1; and WHEREAS, the Village Engineer's Office has reviewed the legal description and sufficiency of same and has recommended acceptance of said easement; and WHEREAS, the Law Director has reviewed and approved the form of said easement; now, therefore, BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. Said easement from Village Trails Development Co. for the purpose of supplying water service in Village Trails Subdivision No. 1 (proposed) is hereby accepted and the Clerk of Council is hereby authorized and instructed to transmit a copy of said easement to the City of Cleveland, Director of Public Utilities, for acceptance, and thereafter to cause said easement to be recorded in the easement records of Cuyahoga County. SECTION 2. The Council finds and determines that all formal actions of this Council relating to the adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.
